These Terms and Conditions apply to all services provided by Crackers Clearout Pty Ltd (“Crackers Clearout”) and remain in effect until replaced or updated.

1. Service Scope

Crackers Clearout Pty Ltd (“Crackers Clearout”) provides home clearance and rubbish removal services as agreed with the customer (the “Client”). Services include the removal and responsible disposal, recycling, or donation of items specified by the Client.

2. Authority and Access

By engaging our services, the Client confirms that:

• They are the legal owner of the property or have the authority and permission of the owner or relevant party to request clearance work.

• They have the right to authorise the removal and disposal of all items specified for clearance.

• Access to the property will be made available as agreed, and any restrictions will be communicated in advance.

3. Ownership of Removed Items

All items removed by Crackers Clearout become our property upon collection. This transfer of ownership enables us to donate, recycle, resell, or dispose of items as we see fit.
Once items have been removed, there is no right or recourse for retrieval.

4. Hazardous or Restricted Items

Crackers Clearout reserves the right to refuse the removal of any hazardous, illegal, or prohibited items that have not been declared prior to the commencement of work.
Asbestos and fibro sheeting will not be removed under any circumstances, regardless of condition or location. The Client is responsible for identifying and disclosing any potentially hazardous materials prior to clearance.

5. Pricing and Payment

Prices are provided via written quotes, verbal agreements, email, text message, or online chat and are confirmed prior to the commencement of work. Unless otherwise agreed in writing, all pricing is inclusive of GST.
Payment must be settled in full upon completion of the job. We accept payment by card, EFTPOS, bank transfer, or cash.
Crackers Clearout reserves the right to request pre-payment or a deposit prior to commencing work, particularly for large or complex jobs.
Changes to the originally agreed scope of work may result in revised or additional costs. Where such changes occur during the course of the job, they will be taken as accepted by the Client unless disputed before work proceeds.

6. Liability

While we take all reasonable care during the clearance process, Crackers Clearout is not liable for:

• Any loss or damage to property unless caused by proven negligence on our part

• The removal of items not specifically identified by the Client as having financial, legal, or sentimental value

• Any damage resulting from access limitations, structural issues, or pre-existing defects within the property

It is the Client’s responsibility to clearly identify, mark, and communicate any items that are not to be removed. Items not identified or marked may be removed and will not be retrievable once taken.

7. Cancellations and Changes

Cancellations or significant changes to the scheduled job must be advised at least 24 hours in advance. Late cancellations may incur a fee to cover allocated resources and lost time.

8. Acceptance of Terms

By confirming the job—whether verbally, in writing, via email, text message, or through our online booking system—the Client acknowledges and accepts these Terms and Conditions in full.
In some cases, a real estate agent or representative may provide confirmation of approval to proceed on the Client’s behalf, and this will be treated as acceptance of these Terms and Conditions.

9. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
